A 13 April 2026 Supreme Court judgment arising from a Delhi matrimonial dispute has given an important example of this situation.
In Dhananjay Rathi v. Ruchika Rathi, the parties entered into a mediated settlement before the Delhi Mediation Centre, Saket.
The husband agreed to pay ₹1.50 crore as full and final settlement, along with other agreed obligations. The first instalment of ₹75 lakh and ₹14 lakh towards the car was paid, jewellery was handed over, and the First Motion for mutual-consent divorce was allowed by the Saket Family Court.
लेकिन इसके बाद wife ने Second Motion के लिए consent आगे नहीं बढ़ाया और subsequently a DV complaint was filed.
The Supreme Court examined whether a party could step back from a mediated settlement after the settlement had been acted upon.
The Court held, on the facts of this case, that although consent for mutual divorce can ordinarily be withdrawn before the final decree, a party that has entered into a duly authenticated settlement cannot simply step back from the terms of that settlement after it has been acted upon.
The Supreme Court ultimately found complete and irretrievable breakdown, exercised its extraordinary Article 142 power, dissolved the marriage and quashed the DV proceedings in the case, while directing compliance with the remaining settlement obligations.
यहाँ husband के लिए सबसे बड़ा lesson सिर्फ “case जीत गया” नहीं है.

इन सबका proper record रखना बेहद important हो सकता है.
